Whoever illegally crosses the country (border) shall be detained for not more than five days or fined not more than 500 yuan in accordance with the provisions of the second paragraph of Article 62 of the Law of People’s Republic of China (PRC) on Public Security Administration Punishment. If the circumstances are serious enough to constitute a crime, he shall be sentenced to fixed-term imprisonment of not more than one year, criminal detention or public surveillance and fined in accordance with the provisions of Article 322 of the Criminal Law of People’s Republic of China (PRC).

Providing conditions for people who cross the country (border) illegally

Those who provide conditions for people who illegally cross the country (border) shall be detained for more than five days and less than ten days in accordance with the provisions of the first paragraph of Article 62 of the Law of People’s Republic of China (PRC) on Public Security Administration Punishment, and shall also be fined more than 500 yuan and less than 2,000 yuan.

Organizing others to steal across the country (border)

Whoever organizes others to cross the country (border) illegally shall be sentenced to fixed-term imprisonment of not less than two years but not more than seven years and fined in accordance with the provisions of Article 318 of the Criminal Law of People’s Republic of China (PRC); If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than seven years or life imprisonment, and shall also be fined or confiscated.

Transporting others across the country (border)

Whoever transports others to cross the country (border) illegally shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance and fined in accordance with the provisions of Article 321 of the Criminal Law of People’s Republic of China (PRC); If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years and shall also be fined.

It is worth noting that

◆ Smugglers who illegally enter the country and refuse to implement the epidemic prevention and control regulations, causing the spread of novel coronavirus or having a serious risk of spread, may be suspected of violating Article 330 of the Criminal Law of People’s Republic of China (PRC), which constitutes the crime of obstructing the prevention and control of infectious diseases. If the stowaway also constitutes the crime of crossing the country (border), he shall be punished with several crimes of obstructing the prevention and control of infectious diseases.

◆ If a stowaway is a confirmed patient, asymptomatic infected person or pathogen carrier in COVID-19, after illegally entering the country, he conceals his illness or information about his trip, enters a public place or takes public transport, thus causing the spread of novel coronavirus, he may be suspected of violating Articles 114 and 115 of the Criminal Law of People’s Republic of China (PRC), which constitutes a crime of endangering public safety by dangerous means. Similarly, if the stowaway also constitutes the crime of crossing the country (border), he shall be punished in combination with the crime of endangering public security by dangerous means.
